These Terms of Use (“Terms”) form a legally binding agreement between you (“Customer”, “you”, “your”) and ТОО "АСПЕКС ГРУПП" (Aspex Group LLP), a company registered in the Republic of Kazakhstan (“ASPEX”, “we”, “our”, “us”). By using the ASPEX CREATIVE AI service (the “Service”), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. About the Service
ASPEX CREATIVE AI is an AI-powered image generation product developed by ASPEX Group, a leading IT integrator with expertise in Business Intelligence (BI), cloud infrastructure, and AI solutions.
The Service operates as a Microsoft Teams bot within your Microsoft 365 environment, using secure Single Sign-On (SSO) authentication and hosted on Microsoft Azure infrastructure to ensure enterprise-grade performance and compliance.

2. Geographic Availability
The Service is available in regions permitted by Microsoft AppSource distribution rules. You are responsible for ensuring that your use of the Service complies with applicable laws in your jurisdiction.

3. Eligibility and Account Access
To use the Service, you must:

• Be at least 13 years old, or meet your country’s minimum digital consent age. If under 18, you must have parental or guardian consent.
• Have a valid Microsoft 365 account and sign in via SSO.
• Hold a valid license in Microsoft Teams for the Service. One subscription equals one user license, which can only be reassigned through Microsoft account administration.

By accessing the Service, you confirm that you accept these Terms, our Privacy Policy, and the Microsoft Commercial Marketplace Terms.

4. Acceptable Use Policy
Our Service is designed for constructive, lawful, and professional purposes. To maintain a safe and respectful environment for all users, you must not:
4.1 Harmful or Illegal Use

• Use the Service for any activity that violates laws or regulations.
• Promote or depict violence, abuse, or any act that could cause physical or psychological harm.
• Create or distribute deceptive or manipulative media (including deepfakes) without the subject’s consent.

4.2 Offensive or Discriminatory Content

• Submit content that contains hate speech, harassment, or discrimination based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, or other protected status.
• Share obscene, sexually explicit, or pornographic material.
• Use excessive profanity or content intended to shock or offend.

4.3 Intellectual Property and Privacy

• Upload or generate content that infringes copyrights, trademarks, trade secrets, or other intellectual property rights.
• Share personal or confidential information about yourself or others without consent.

4.4 Technical Misuse

• Attempt to bypass our moderation systems.
• Reverse engineer, disrupt, or impair the functionality of the Service.
• Use the Service in ways that place unreasonable load on our systems.

Moderation: We use automated review procedures to detect and block prohibited content. Moderation decisions are automated and final. Where required by law, we may report violations to authorities.

5. Content and Safety Policy
ASPEX CREATIVE AI operates under strict content safety principles:

• No NSFW or harmful content: We do not produce, store, or distribute content that is sexually explicit, pornographic, promotes violence, discrimination, or illegal activities.
• Automated and human moderation: All prompts and generated outputs are automatically scanned using Azure AI Content Safety, and may be subject to human review to ensure compliance.
• Immediate blocking: Any attempt to generate prohibited content will result in immediate blocking of the request, and may lead to suspension of the account.
• No retention of harmful content: We do not store or retain any flagged content. All prohibited material is blocked at generation and discarded.
• Cooperation with authorities: In case of serious policy violations, ASPEX may provide information to law enforcement as required by applicable law.

8. Service Availability and Changes
We aim for high availability but do not guarantee uninterrupted operation. We may suspend or change the Service for maintenance, updates, security, or compliance. Significant changes will be communicated in advance when feasible.

9. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind.

• Generated content may contain inaccuracies and should not be solely relied upon for decision-making.
• The Service is not intended for critical uses such as medical diagnosis, emergency response, financial trading, or other high-risk applications.

10. Limitation of Liability
To the maximum extent permitted by law:

• ASPEX will not be liable for indirect, incidental, special, or consequential damages, including loss of profits, business interruption, or data loss.
• Our total liability for any claim shall not exceed the maximum permitted under applicable law.

11. Termination
We may suspend or terminate your account without notice if you:

• Breach these Terms or applicable laws.
• Use the Service in a way that poses a security or legal risk.
• Are required to be suspended under regulatory or legal orders.

You may stop using the Service at any time.

12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of Kazakhstan, without regard to conflict of law principles. Disputes will be resolved exclusively in the courts of Almaty, Kazakhstan.

13. Changes to These Terms
We may update these Terms periodically. For significant changes, we will provide at least 30 days’ notice. Continued use after updates constitutes acceptance of the new Terms.
